Why Doesn’t My Favorite Retailer Offer CBD Products?

With over 42% of Americans using over the counter CBD products to increase health and replace other dietary supplements or prescription medications, a common question is, why do these products need to be purchased online or at specialty CBD stores?1The lack of consistent regulations regarding how the Food and Drug Administration (FDA) and the Financial Industry Regulatory Authority (FINRA) view the hemp industry has restricted the ability of your favorite retailer to offer CBD products. Fortunately, recent bills and approvals are moving cannabidiol to mainstream acceptance, potentially allowing more convenient access to industrial hemp products.

Industrial hemp, or Cannabis sativa L., became federally legal with the approval of the 2018 Agriculture Improvement Act, more commonly referred to as the Farm Bill. Although this bill stated that hemp is legal to grow and products derived from industrial hemp were legal to make, there has been much confusion on how to tease apart the hemp industry from marijuana businesses. Because both industries work with Cannabis strains, the distinguishing feature between marijuana and hemp is the level of tetrahydrocannabinol (THC), the psychogenic compound found in the plant which by definition must be lower than 0.3% for industrial hemp, adding to the confusion among existing legal and regulatory frameworks.

Banking and Regulatory Roadblocks

 

Currently, marijuana containing greater than 0.3% THC is classified as a schedule 1 drug and is federally illegal. Although several states have enacted laws and regulation allowing the sale and production of marijuana, federal institutions such as the Drug Enforcement Agency (DEA) and FINRA view marijuana as an illegal drug that prohibits interstate commerce and banking to protect from drug money laundering. While the implications of banking restrictions are wide ranging, an important aspect is the lack of regulatory approval by FINRA does not allow major banks and credit card processors to accept marijuana transactions. Fair or not, hemp or CBD businesses have been lumped into marijuana banking restrictions. Relief is on the way though, as just last week, the SAFE (Secure and Fair Enforcement) Act was approved by the House of Representatives, and if this bill becomes a law, banking for both marijuana and hemp will be similar to legal businesses, allowing major retailers to consider offering CBD products to their consumer.

In parallel, the FDA has not provided guidance as to how CBD products should be classified. Since GW Pharma entered CBD into clinical trials in 1997, prior to the marketing or sale of CBD products, the FDA is obligated by law to consider CBD as a drug. Because there has been a large public interest with numerous companies selling CBD products in recent years, the FDA has been working to reconsider how to regulate CBD. Last year, FDA Commissioner Stephen Hahn stated, “People are using these [CBD] products. We’re not going to be able to say you can’t use these products. It’s a fool’s game to try to even approach that.” In the past year, the FDA has been working to determine the safety of CBD and explore how to regulate products containing this cannabinoid.

Regulation Matters

 

Proper regulations are extremely important for the over the counter CBD products industry so consumers are properly informed and products are made to potency and purity standards. Knowing how products are regulated is also important for retailers because it ensures proper labeling and helps to avoid product recalls, which are costly for both the retailer and product manufacturer. To this point, it is estimated that approximately 70% of Over the counter CBD products do not meet potency and purity requirements.2Many products do not contain the stated quantity of CBD in them and may even contain high levels of THC — not to mention the possibility of them also having impurities such as pesticides or heavy metals. With the FDA impasse on how to move forward, congress has introduced bill HR841 to provide legal authority for the FDA to regulate CBD as a dietary supplement.

This law would emulate the path taken by many progressive states that have embraced the CBD industry with set regulations. Colorado, for example, has enacted some of the best regulations for the hemp industry in the nation that provide clear guidance on how products will be manufactured and labeled. The Colorado regulations provide consumer information regarding products, protect the consumer from impure products, and allow a clear business approach for manufacturing. Likewise, California recently passed AB45 that legalizes the incorporation of hemp products into food, dietary supplements, cosmetics and pet products. While this bill is awaiting the governor’s signature, California’s Department of Health will consider how these products will be regulated within the state.

Overall, the past few months have provided more (much needed) clarity on the banking and regulatory pathways for CBD and industrial hemp products. Once the banking and regulatory definitions of hemp products are determined through various federal and state bills, retailers will begin carrying CBD products. This is a very important step allowing quality products to be made available to retailers while also allowing more Americans reliable and convenient access to the healing power of industrial hemp.

Cannabidiol for Hair Growth

Androgenetic Alopecia (AGA), or hair loss, affects an estimated 50% of Caucasian men and 19% of Caucasian women, not using CBD for hair and skin have an increase in hair loss as people age. While this condition is not life threatening, Alopecia may negatively impact a person both psychologically and socially, especially in women.1All of us want to look and feel youthful, and a full head of hair is one trait valued for personal attractiveness. AGA is hypothesized to be caused by a variety of factors including the presence of dihydrotestosterone (DHT) in both men and women. In the United States, individuals spend more than $3.5 billion on hair loss products and procedures marketed to promote restoration of hair growth, many of which provide marginal improvements.2Although hemp extracts have had mixed reviews on effectiveness regarding hair growth, a recent study indicates that specific cannabinoids may help benefit hair loss and promote hair growth through topical applications.

Currently, two medications for CBD for hair and skin have been approved by the FDA for treatment of AGA: Minoxidil topical and oral Finasteride. Unfortunately, both medications offer limited results.3,4Minoxidil, a topical treatment that is a vasodilator, increases blood flow to the affected area of application and over a four-month treatment can increase hair growth up to 83% using a 3% solution.5Finasteride, a 5a-reductase inhibitor that was originally developed to treat men with benign prostate hyperplasia, decreases the ability of the body to produce testosterone. Finasteride at a dose of 1 mg/day increased hair growth by 14% after a one-year treatment.6Clinical studies are currently underway to explore the use of combinations of Minoxidil and Finasteride and whether combination of the two drugs may increase hair growth.7

How Does CBD Affect Hair Growth?

Interestingly, cannabinoids have been reported to also have effects on hair growth. Anecdotal and scientific publications have reported that cannabis extracts have both promoted hair loss as well as hair growth. A recent clinical publication exploring the effects of CBD-rich extracts helps to clarify prior seemingly contradictory information.8Cannabinoids, such as cannabidiol (CBD) and the psychogenic compound, tetrahydrocannabinol (THC), both exert biological effects through the body’s endocannabinoid system (ECS). The ECS is present throughout the body and is involved in maintaining cellular homeostasis in response to excess oxidative stress. Until recently, the ECS was thought to be comprised of only the CB1 and CB2 receptors, although subsequent studies have demonstrated that this definition needs to be redefined as cannabinoids interact with over 75 distinct receptors and enzymes.9,10,11

Studies have shown that the ECS is a key regulator of hair follicle cell growth and control. As shown in Figure 1, both CB1 and CB2 receptors are expressed in multiple skin cells, including hair follicles. Stimulation of the CB1 receptor leads to decreased hair shaft elongation, cell death, and hair follicle regression. The vanilloid receptor TRPV1 is located on hair matrix keratinocytes, and stimulation of this receptor also leads to hair follicle regression.12Examination of cannabinoid activity through these two receptors begins to explain the seemingly contradictory activity of cannabinoids when it comes to hair growth. THC stimulates CB1 and TRPV1 to result in hair loss, whereas CBD inhibits CB1 receptor activity and effectively shuts down TRPV1 signaling by causing fewer TRPV1 receptors to be present. Additionally, CBD for hair and skin has been described as an anti-inflammatory, so it may have indirect effects on hair growth through reduction of scalp inflammation.13

The Case for CBD

To demonstrate the effects of CBD on hair growth, researchers Gregory L. Smith and John Satino recruited 35 subjects (28 males and 7 females) that were provided a topical extract containing 54 mg CBD per ounce (also containing 1 mg/ounce of THC). The extract was applied daily for 14 weeks. The results demonstrated significant hair growth increases, similar to Minoxidil, of 74.1% in men and 55.2% in women. Longer times of treatment or studies to determine optimal dose of CBD have not been conducted. Because there is some uncertainty on whether higher doses of CBD would be beneficial, it certainly warrants more research. Additionally, the study did not address whether a full spectrum CBD-rich hemp extract is more effective than a THC-Non detect (<0.01% THC) extract. One may predict based on the molecular mechanism of activity described above, that elimination of the THC component would be beneficial to promoting hair growth. Since CBD works through a different mechanism than other known hair treatments such as Minoxidil and Finasteride, clinical studies should be conducted to explore whether these compounds may be used in combination to exert greater positive effects.

Currently, CBD and cannabinoids have been reported to have positive health benefits for numerous conditions. Although a majority of the results regarding CBD’s biological effects have not been examined by the FDA, nor are CBD products allowed to have claims on the prevention, diagnosis, or treatment of disease, the possibilities are exciting. People suffering from Androgenic Alopecia who have had poor results with existing medications or do not want to undergo hair transplant treatments, may wish to explore CBD to support scalp and hair health. Based on the G.L. Smith research, topicals should contain greater than 50 mg CBD per ounce and applied daily.

Graphene is a material composed of only carbon atoms, arranged in a lattice structure that gives this material an extraordinary strength-to-weight ratio, but more importantly, makes graphene a great conductor of electricity. Graphene has potential use in a wide range of industries from energy storage to advanced electronics and even has uses in medicinal therapeutics.[1] It is projected that by 2026, the global graphene market will reach USD 221.4 million at a CAGR of 47.7%.[2] The goal for these teams of students is to design a process that converts hemp and hemp-waste into graphene oxide and/or other graphene products, using the spent hemp feedstocks from extraction processes and/or hemp biomass collected prior to extraction of hemp resins.

Panacea will own any intellectual property that comes out of the project which could offer them a starting point as they dive into new technologies. The biggest challenge the students face is figuring out if it is viable and cost-effective to separate the bast (the core of the hemp stalk) from the cannabinoid-rich inflorescence. What is (cannabidiol) CBD?

Is CBD legal? What about THC?

This question is important to answer as there is a general misconception about CBD and whether or not it is legal. The two main cannabinoids of the cannabis plant are CBD and THC. These two are often not separated and not understood to be different. But they are! CBD does not give psychoactive effects to those who use it. Because of this, THC is not considered federally legal. In 2018, the Farm Bill gave farmers the ability to grow hemp in all 50 states. Hemp is defined by the percentage of THC it contains. To be classified as hemp, a cannabis plant contain no more than .3% of THC. So, yes! CBD is legal. If you live in a state that has recreational use of THC, it is important to check labels to make sure that you are getting CBD from a hemp plant, not marijuana, if you wish to be sure that there is less than .3% of the THC cannabinoid.

What is the difference between CBD (cannabidiol) and THC (tetrahydrocannabinol)? 

This is likely the most researched question surrounding CBD, because there is a lot of misinformation out there. CBD and THC are two of the cannabinoids that are derived from the cannabis plant. CBD is often reported to give a sense of calm and THC has a psychoactive effect. There are a handful of states that allow the use of medical marijuana as well. That is the biggest difference between THC and CBD, THC creates the “high” effect and CBD does not produce a “high” effect but may provide a plethora of health benefits. Both of these compounds are utilized by the Endocannabinoid System (ECS) but make the body and mind feel differently.

Why should I use CBD? Are there real benefits?

There are plenty of reasons a person might be interested in using CBD. Here are a few:

Anti-inflammatory traits – CBD has been reported to reduce joint inflammation in many studies. This includes a study done by Panacea Life Sciences that tested dogs with Osteoarthritis. Epidiolex- Some of the benefits for reducing seizure frequency and intensity are being used in conventional pharmaceuticals. Epidiolex is known as the only FDA-approved supplement that contains CBD. Epidolex is used to treat Lennox-Gastaut syndrome and Dravet syndrome which are two types of harsh epilepsy. This treats seizures and is approved to be administered to children and adults two years old and older.

Mental wellbeing- In this study, they found that CBD assisted rats with managing feelings of helplessness and anhedonia (the loss of interest in activities that gave feelings of pleasure or happiness before). We can infer that this would give an over sense of mental wellbeing.

Sense of calm – CBD has been reported by users to assist those who may have an increased sense of anxiousness caused by day-to-day activities. Reviews and reports from CBD users and administrators say that CBD helps them to feel calmer.

Skin health – This study tested skin health across many indicators before and after the use of CBD. It measured elasticity, hydration, and a transepidermal water loss test. Support from this was found in photographic evidence from the study. They found that the administration of a topical CBD ointment may be a positive way to improve skin health for those with or without skin conditions.

What is CBD Hemp Oil? 

Marijuana and hemp are strains of the plant Cannabis sativa. CBD hemp oil is generally extracted from the hemp plant. It is important to know the difference between the two plants, because the marijuana plant is not legal in all states and those products are not available everywhere. Make sure to check the labels on CBD products to see what type of cannabis oil is in it. Cannabis oil and CBD oil have varying amounts of CBD and THC. Cannabis oil is known to have more than the .3% of THC that the hemp plant does. CBD hemp oil is derived from the flowers and leaves of the hemp plant. Balms: The skin has the lowest bioavailability therefore when using a CBD balm or salves it is imperative that the use is consistent to get the full benefits. Apply allover for a full effect or in one area to reap the benefits of localized skin maintenance.

Let’s cut to the chase: where can’t you find CBD?! 

Walking into your favorite coffee spot before the passing of the 2018 Farm Bill (we’ll get back to this later) was a much different experience than the one you might encounter now. Instead of the usual bagels and day-old muffins lining the shelves and adorning the display boards, Cannabidiol (CBD) seems to have seized the spotlight.

Whether it be adding an oil or tincture shot to your morning beverage of choice, indulging in an additional CBD-infused goodie like chocolate truffles, or even purchasing your very own oil bottle—CBD is popping up everywhere in a seemingly boundless number of forms, making the dynamic product one worth celebrating. Hooray for creativity! 

Go for the Gummy Gold

The ever-trendy and ever-abundant CBD gummy is among the more popular choices. These playful little treats are not only popular in the CBD community, but the vegan community as well. 

If you are vegan, vegan-curious, a conscience eater, or any which way you choose to live your life, CBD is just as accessible to you as, say, your favorite non-dairy milk. But before we begin explaining just why exactly the gummy has us jumping for joy, let’s get some background info on this whole CBD craze. 

What is CBD?

Cannabidiol, affectionately known as CBD, is a naturally occurring chemical compound sourced from plants of the genus Cannabis, namely the hemp or possibly the marijuana plant. It is one of the two most prevalent of 113 identified cannabinoids found in the cannabis plant. The other most prevalent is tetrahydrocannabinol (THC). While both compounds are molecularly similar to your body’s endocannabinoids and thus able to interact with your cannabinoid receptors, they produce very different effects. 

THC binds with sturdy ease to the cannabinoid (CB) receptors in the brain, producing feelings of euphoria. This “euphoric” experience is what we call a “high,” and is the reason we refer to THC as psychoactive. 

Cannabidiol, on the other hand, is non-psychoactive. It is unable to bind as tightly with the CB receptors as THC is. The result is an experience of calmness and relaxation, unlike the mind-altering, high THC yields. 

Why Use CBD?

There are a multitude of reasons more and more people are choosing to add CBD as a supplement to their supplement routine or even replace components of their routine in exchange for the potential benefits cannabidiol may offer. One major factor driving people to do so is CBD’s lack of side effects in comparison to those prescription drugs often produce. On top of that, it has been suggested that CBD is a safer, non-addictive alternative. According to the World Health Organization, “… CBD exhibits no effects indicative of any abuse or dependence potential… To date, there is no evidence of public health related problems associated with the use of pure CBD.”   

While more research is necessary in continuing to unveil the precise mechanisms of CBD, current research has jumped at the opportunity to study cannabidiol in a number of varying contexts. Due to the fact that CBD interacts with the endocannabinoid system, it is no wonder researchers were curious to explore whether the chemical compound’s interaction might alleviate or improve certain systems regulated by the endocannabinoid system, including sleep, appetite, pain and immune system response.1 

To no one’s surprise, an influx of promising findings has continued to stream in from the academic world. 

A number of studies have reported that, due to the endocannabinoid interaction, CBD may help reduce inflammation, a common cause of bodily discomfort.2 One study in particular assessed participants with rheumatoid arthritis and their response to a CBD and THC supplement. Researchers reported improvements in participants’ sleep quality, pain during movement, and pain while at rest. 

Another area researchers have been eager to dive into is mental wellness. A number of studies have suggested a possible benefit to the use of cannabidiol with anxiety and depression. One example is a study in which participants were sorted into a placebo group, while two control groups receivied either 300 milligrams (mg) or 600 mg of CBD. Researchers then measured signs of anxious feelings in participants during a simulated public speaking test. It was reported that the 300 mg group exhibited the most significant reduction in anxiety. 

Clinical research has also researched the potential of CBD to aid children with post-traumatic stress disorder (PTSD), successfully providing relief from stress and inability to sleep, related to the children’s PTSD-induced insomnia and anxiety.  

We could go on and on, citing studies demonstrating the potential benefits of cannabidiol, but to keep things moving and get to the gummy stuff—I mean, good stuff—we won’t. Rather, we will simply share that in addition to these findings, studies have also reported potenital in CBD’s ability to reduce or relieve discomfort related to acne, epilepsy, migraines, drug dependence, multiple-sclerosis, Parkinson’s, chemotherapy-related nausea and vomiting, and more. On the flipside, research has also suggested CBD may fight against disruptive issues related to heart health, diabetes, immune system responses, and more.3  

Let’s Get to the Gummies 

Now that you understand some of the possible benefits, you’re likely eager to start your own little research study, right? We understand—it’s exciting stuff! And who wants to hold off getting their hands on something that may improve their quality of life?

There are a number of ways to self-administer CBD, all worthy of a look-over and all unique in their (occassionally subjective) upsides and downsides. But let’s start with the obvious one:

Gummies!   

Much like the cutting-edge research, we could go on and on raving about these little drops of heaven. Not only are they small, easily transportable, and easy to eat with the flick of a lid and quick pop in the mouth, they come in an array of delicious flavors, shapes, doses, and formulas. 

The three types of CBD formulations in gummies are CBD Isolate, meaning no funny business, just pure CBD without other cannabinoids or THC. Broad-Spectrum CBD, containing CBD and most cannabinoids, but zero THC. And lastly, Full Spectrum CBD, containing all the cannabinoids available from the hemp plant, including THC.

While there are a ton of commercially available products, the Federal Drug Administration (FDA) has not yet approved any over the counter (OTC) products.4 Why? Well, despite the fact that CBD is federally legal (remember the 2018 Farm Bill? This is us getting back to it,) this legalization only applies to products derived directly from hemp and consequently contain no more than 0.3% tetrahydrocannabinol. Laws vary state by state, so it’s important to check your state’s laws and speak with a medical professional about the best way to obtain a safe, quality product.

One of the most exciting aspects of the gummy is its variety. The options are so fun and so endless you feel like an adult in a candy shop.
