Before we can talk about the legality of CBD or where to get it, it is best to go over the basics.

Cannabis plants, like hemp and marijuana, have chemical compounds in them called cannabinoids. There are over 113 different cannabinoids that are found in cannabis. CBD is just one of these. There is another cannabinoid that you have more than likely heard of in connection to cannabis. That cannabinoid would be tetrahydrocannabinol (THC).

THC is very well-known. This is because of its psychoactive effect on those who use it. That means that it creates the inebriations (more often referred to as a high) that is so commonly associated with cannabis. Because THC is a cannabinoid, the general thought is that all cannabinoids are psychoactive which is not the case. THC is the main psychoactive component of cannabis. Other cannabinoids, CBD especially, are not psychoactive. Most of them (again, especially CBD) do not create any sort of high.

Part of CBD’s popularity comes from the research that has been done on the cannabinoid in recent years. Many of these studies have shown promising results that suggest that CBD may be able to offer a plethora of health boosts. For example, this study showed that CBD has both antidepressant and calming qualities, meaning that it may be able to help you achieve a calmer state of mind. Another study found that CBD may be an important aid in helping reduce inflammation caused by oxidative stress.

Is CBD legal in the United States?

Let’s start by answering this question right away; yes, CBD is perfectly legal in the United States (with certain restrictions). Which also means that it is available for purchase in every state. Now, let’s get into the details as to why exactly it is legal.

In 2018, a new version of the Farm Bill was passed. This is a bill that is reviewed, revised, and passed by the federal government every five years. The purpose of this bill is to lay out guidelines for all things agricultural, including what farmers can and cannot grow and sell. The 2018 version of the bill included a provision that legalized hemp.

You may be wondering what the differences between hemp, marijuana, and cannabis. Cannabis is an overall term referring to of the genus of plant. Hemp and marijuana are different species and substrains of cannabis. The differences between those two variations lies in the concentration of cannabinoids. Hemp is low in THC (in fact, it is legally defined as containing less than 0.3% THC) and high in CBD. Marijuana, on the other hand, is very high in THC. Its CBD levels vary but are often overshadowed by the THC.

The differences in THC levels is why hemp has been federally legalized. The THC content in hemp is not enough for the psychoactive qualities of THC to have any real effect. Marijuana is still federally illegal. However, a handful of states have legalized it. Some have only legalized the cannabis variation for medical use, while others have legalized it for recreational use as well. But what does this have to do with CBD?

Most CBD manufacturers prefer using hemp to extract the cannabinoid. This is because the high CBD levels and low THC levels makes the extraction process that much easier. What kind of CBD products are there?

You may be wondering what CBD products are available in all of the 50 states that sell the cannabinoid. Clearly, there is such thing as a CBD oil. But what exactly is an oil and what other products are there?

Tinctures & oils

It seems only fair to talk about oils first. CBD oils often get grouped together with tinctures, that is because they are pretty similar. They are CBD extract that has been mixed with a carrier oil, like coconut oil for example. These you take orally. You can mix them in with food or drink, but they work faster when taken more directly. You can place the drops into your mouth, under the tongue where the skin is thin. There the CBD can absorb more quickly into the system and start working faster.

Edibles

These are what they sound like. They are food and drink that have been made with CBD extract. Edibles are probably the most popular CBD product. This is because they are easy to take and taste great. However, they do have their downside. They are one of the slowest ways to take CBD. Because the food has to breakdown and digest before the CBD can enter the system, they take a long time for the CBD to get to work.

Capsules & tablets

Sometimes CBD is made into more pill-like products, like capsules and tablets. Most CBD capsules are made as soft gels. This means that they tend to digest and start working faster than regular pill-like products. CBD tablets are usually sublingual. This means that you place them under your tongue and allow them to dissolve. Much like with tinctures, this allows the CBD to enter the bloodstream more quickly.

FDA-approved medications

There are some CBD-based medications that have been approved by the Food and Drug Administration (FDA). One of these is Epidiolex. Topicals

This is a broad term to cover a whole category of products. It is basically any lotion, cream, salve, or any product that you rub on your skin that is made with CBD. These are not going to provide as much of an overall effect that the oral products may offer. This is because the CBD in topicals does not enter the bloodstream. It instead absorbs through the pores and does its work in the area that it is applied.

What different kinds of CBD extract are there?

It is good to know what you are looking for when it comes to CBD. So, you should be armed with the knowledge of the different kinds of CBD extract that CBD products are made from. There three main ones that you are likely to see. They are full spectrum, broad spectrum, and CBD isolate. Their differences lie in what exactly is in the extract other than everyone’s favorite cannabinoid.

Full spectrum

This is the least filtered form of CBD extract. It has everything that comes with the CBD during the extraction process. This includes other chemical compounds and cannabinoids. This also includes THC, however as discussed above, the THC content is never over 0.3% and is not enough to cause a high.

Broad spectrum

Broad spectrum is pretty similar to full spectrum. However, it has one very important difference; it does not have any THC in it. After the CBD is extracted, the THC is filtered out leaving the CBD and the other cannabinoids. The appeal of full and broad spectrums is a potential boost in strength of the experience. This is called the entourage effect. The idea is that the other compounds all build on each other to make the main compound stronger.

CBD isolate

It is probably pretty easy to guess what CBD isolate is when you have the above information. CBD isolate is the most filtered form of CBD extract. It has all of the other compounds and cannabinoids filtered out of it, leaving only CBD. The appeal of this over the other two is that is may be able to provide you with a clearer CBD experience. It does not have any of the other compounds providing any of their influence.

What is the right amount of CBD to take?

If you are looking for a simple, straight-forward answer to this question, you are going to be disappointed. The right amount of CBD depends on the person taking it, as everyone reacts to the cannabinoid a little differently. As a result, it may take you some experimentation to find the right amount of CBD for you.

Because of the rise of CBD and having less confusion surrounding what it is, people are wondering why they should add it to their daily schedules. There are a handful of reasons people have begun to use CBD. One of them is increasing overall health. This reason in particular has had little research done surrounding it, but that does not mean that we cannot do a little digging ourselves. One of the other reasons that CBD has become so popular is because of the natural way it is derived, and folks are leaning more toward a more holistic way of health. Before we dive into the nitty gritty, let us start from the very beginning. Cannabidiol, what is it?

CBD: What is it?

Let’s break it down. What is CBD? CBD or cannabidiol is one of the 113 cannabinoids found in the Cannabis sativa plant. The Cannabis sativa plant is a naturally occurring plant that comes in a variety of different types. One of these types is the hemp plant. The hemp plant contains high amounts of CBD and has low amounts of tetrahydrocannabinol (THC).

You likely have already heard of THC as it has been at the forefront of the conversation surrounding Cannabis sativa. The reason THC is so well known is because of the psychoactive effects that it has on the brain. THC creates a euphoric feeling or, in slang terms, a ‘high’. The low amounts of THC in the hemp plant cannot get people who use CBD or hemp products ‘high’. This is the reason that the hemp plant versus the marijuana plant is legal throughout the United States.

In 2018 the Farm Bill was passed. This bill allows farmers across the country to grow and sell the hemp plant legally. The percent of THC allowed in a hemp or CBD product is 0.3%. This low amount, again, does not cause the euphoric feeling described. However, there are some states that have legalized the growth and selling of the marijuana plant. The marijuana plant has high amounts of THC and less, equal or no amounts of CBD. These products are used for medical purposes as well as recreational purposes. CBD is more widely used because of the legality as well as the potential health wellness benefits that keep arising. 

What are ongoing conditions?

Now that we understand what CBD is and what it is not, let’s get down to what our readers are here for. Ongoing conditions. What are ongoing conditions?

Ongoing conditions are, put simply, health conditions that will always be there. Ongoing conditions are also interchangeable with the term pre-existing conditions. Some examples of ongoing conditions are epilepsy, diabetes, lupus, sleep apnea, high blood pressure, heart disease, and asthma. This is just a short list of some ongoing conditions, but there are plenty more. Some of these conditions may have always been there or they arrived at a certain time in your life. Some are easily managed, others not so much. There is no cure-all for these conditions, they are only able to be managed. Can CBD manage ongoing conditions? Perhaps. There still needs to be plenty of research done surrounding CBD and its effect on health, but we have evidence of one.

Epidiolex is one of the only FDA (U.S. Food and Drug Administration) approved medications containing CBD. It is used for people who have one of two very severe forms of epilepsy. These forms of epilepsy are called Lennox-Gastaut syndrome or Dravet syndrome. This medication treats seizures associated with the syndromes. Only those 2 years and older are able to use the medication, but this is highly important to the CBD world. The evidence shows that CBD has amazing capabilities that we are just beginning to understand.  More research is needed to fully describe the full extent of CBD effects on health.  Epidiolex, like other medications, has its side-effects but it is the first and only medication to be approved for Dravet Syndrome. Although this is just one medication that proves that CBD can assist ongoing conditions it gives hope that there may be more in the future.

There is one study that we can look at to see the potential of CBD assisting those with ongoing conditions. This study does not follow humans but follows horses. Forty-one horses were selected for this study because they had observed movement issues such as an altered gait, as well as feelings of anxiousness. In this initial study the horses were given 50 mg of CBD regardless of body size to observe potential effects. The CBD was given twice a day for two weeks consecutively. The horses’ caregivers were  to take an assessment specifically designed for the study at the end of each week. The study indicated that there were significant improvements in movement and a trend towards decreasing anxiety behaviors.  However, the researchers did state that more directed studies need to be performed to reach firm conclusions on dosing and effects.

CBD products

Now we understand that CBD has the potential to assist those with ongoing conditions. Besides Epidiolex, what types of CBD products are available? There are lots of available CBD products and more and more are continuing to pop up. Here is a list of a few we have available:

  • Tablets: This type of CBD is very easy to use. You just place it in your mouth, let it dissolve and you are done! After being dissolved the CBD reaches the bloodstream through the mouth.   • Topicals: CBD topicals typically do not reach the bloodstream but may provide benefits through the pores of the skin. These topicals come in salves, creams, and lotions. Since they are both cannabinoids, THC and CBD often get lumped together, making people think that CBD can cause a high. However, this is an erroneous line of thought. CBD is not psychoactive. It will not cause any inebriation or high.

CBD was officially legalized in the United States in December of 2018. This happened as a result of the 2018 Farm Bill. The Farm Bill is a law that gets reviewed every five years and has an effect on what farmers can grow and sell. That year the bill included a revision that legalized the growing and selling of hemp. This had a major impact on CBD as hemp is bred to have more CBD and little THC (less than 0.3%, in fact). Full-spectrum

This is the CBD strain with the highest number of other cannabinoids and compounds. In fact, this is the kind that keeps all of the other things that come with the CBD during the extraction, including THC. However, if this is a concern for you, no need to worry. The THC concentration cannot be more than 0.3%, which is not enough to cause a high. This kind of CBD extract is considered to be the strongest due to the Entourage Effect. This is when compounds build on each other to create a stronger effect.

Depending on how strong of an effect you are looking for, you may want CBD isolate, or you may want full-spectrum. You may even want to try a few different kinds, just to get an idea of which one works best for you.

How do I know how many CBD gummies to take?

This question can be a little tricky to answer. CBD sits differently with each person. Some people require a lot, some a little. So, how do you know which you need? Well, you do not know until you start taking it. But this needs to be done carefully as CBD does have some side effects that are associated with taking too much.

These side effects are not usually life threatening, however they still are not fun to deal with. They tend to include things like fatigue and nausea. When taking CBD, if you start noticing side effects like that, you know you are taking too much. However, there is no need to take CBD until you notice negative effects.

What is CBD?

Extraction Process

There are several different ways that CBD is extracted from the variations of the Cannabis sativa plant. Here are three common ones:

Steam Distillation: In this extraction process the steam separates the CBD oil from the plant itself. The hemp is placed in a separate container while a boiler is full of water beneath the hemp. Once boiling, the steam travels upward to extract the CBD oil vapors from the hemp plant. The vapor from the plant is then trapped in a tube and added to oil or water. After this is collected, the oil is extracted from the water to make an oil.

Solvent Extraction (Hydrocarbons and Natural Solvents): This process is similar to the above method. But, in this process one would use a type of solvent rather than water. The solvent and CBD oil are combined and then the solvent is extracted leaving the CBD behind. There are two types of solvents used: hydrocarbons and natural solvents.

Carbon Dioxide Extraction: Carbon dioxide extraction uses both carbon dioxide liquid and gas properties to extract. To start this extraction, two different pressurized chambers are used. One, with the carbon dioxide, while the other holds the hemp plant. As the interest in cannabidiol (CBD) increases so does the number of different CBD products. Recently, this list of products has started to include CBD-based medications. There is one specific medication that has received much attention: Epidiolex. But what exactly is Epidiolex? What does it do?

Laying down some groundwork: what is CBD?

Before we start talking about the specifics surrounding Epidiolex, we should cover what exactly CBD is and why it is such a big deal.

In cannabis plants there are over 113 different chemical compounds that are known as cannabinoids. Each cannabinoid has its own name and properties, but most of them are not very well-known. However, there are two that you have more than likely heard of. One is CBD, the other is tetrahydrocannabinol (THC).

Because they are both cannabinoids, THC and CBD are often lumped together, which leads to some serious misconceptions about the compounds. One of them comes from the fact that CBD is psychoactive. That means that it creates the intoxication that is commonly associated with cannabis and is more often referred to as a “high.” Because of their connection, many think that CBD will also make people high. What is Epidiolex and how did it come to be?

Epidiolex is a CBD-based medication that is aimed at helping reduce epileptic seizures, especially in children. But how is CBD supposed to help with that?

There have been many studies evaluating CBD and epilepsy, and most of them, in not all, have shown very promising results. For example, this study studied the cannabinoid’s potential using seizures induced in both in vitro and in vivo animal models. The researchers concluded that CBD was able to reduce the number of seizures the test subjects experienced.

Another study wanted to look at how CBD dealt with epileptic behaviors (including seizures, of course) in rats. This was done by inducing the seizures after having treated some of the rats with CBD. The researchers found that the rats who had been given CBD beforehand did not have or did not have as intense seizures as the ones who were not given any of the cannabinoid.

These and many other studies gave researchers more confidence to say that there is evidence that CBD could help reduce the number of seizures experienced by those with epilepsy. That led to the development of Epidiolex. But there is an important question to be asked; is it legal, seeing as it comes from cannabis?

Is it legal?

The quick answer is, yes, Epidiolex is perfectly legal when prescribed by a doctor. But let’s get into the details of CBD and CBD-based medications and their legality.

As discussed above, CBD is usually extracted from hemp rather than marijuana. This is not just because of the content of CBD within these plants. It is also because hemp is federally legal in the United States and marijuana is not. Some states have legalized marijuana on some level, but as a whole, it is still illegal. This is because marijuana has high levels of THC. There is concern over the effect that THC has on people, so it is difficult to legalize it.

Hemp, by legal definition, has less than 0.3% THC content. This was one of the driving arguments in the legalization of the plant. This happened in late 2018 when the Farm Bill was passed. This is a bill that is passed every five years and deals with all things agricultural, including what farmers can and cannot grow and sell. That year the bill included a provision that allows farmers to grow, sell, and distribute hemp.

Luckily, this is where Epidiolex has made history. In 2018 it became the first pure CBD based medication to ever be approved by the FDA.

These are often considered the more basic way of taking CBD. They are usually just CBD mixed with a carrier oil, like palm oil. They offer a couple of different ways to take them. Some people prefer mixing a drop or two in with a drink. However, many oils and tinctures are flavored, so other people tend to place the drops directly into their mouths, placing them under their tongue. This is likely because they taste great and are very easy to take (after all, you just eat or drink them). However, they are one of the slowest ways to take CBD. Like capsules, they need to digest before the CBD can enter the system.

Topicals

This category of CBD product includes things like lotions, salves, and cremes. They are basically anything that you rub on your skin that is made with CBD. Topicals are less likely to provide an overall effect. They are more likely to have a localized effect instead. This is because the CBD does not absorb into the bloodstream. Despite this being a good question, there is no exact answer. People tend to react differently to CBD. Some only require a little bit to get their desired effect without side effects. After four weeks of giving CBD to their dogs twice a day, owners described that their canines had increased mobility. This research included only dogs that had visible or noted movement issues, but based on these results, we can infer that it may offer some help for all dogs suffering from joint health issues. Another reason people have decided to use CBD is because of the possible benefits it has on those who get feelings of anxiousness. In this study Panacea observed horses to test the possible effects of CBD on joint health or feelings of anxiousness. This was a two-week study where the horses where administered 50 mg CBD two times a day. The researchers found that the use of CBD lowered the horse’s discomfort as well as helped produced a sense of calm.

These studies are great indicators of what CBD could possibly assist your pet with. With that being said it is important to speak with a veterinarian before administering CBD to your pet. Start off with a lower amount and then slowly increase until you see the results you want.

CBD is federally legal in the United States. This is because of the 2018 Farm Bill. This bill did a number of things, one of which was making industrial hemp legal to grow and sell across the country. It also included legalizing products made from hemp, that includes CBD products.

So, yes, CBD is legal in the United States, but how do sports organizations feel about it? Afterall, there are a lot of things that are banned from use in professional sports. However, when it comes to CBD it is not that much of a worry.

The World Anti-Doping Agency (WADA) protects athletes and ensures that competitors are held to the same standards on what supplements athletes can take.  This allows athletes to compete equally without performance enhancing drugs.  Because of a concern on safety and performance, WADA bans most cannabinoids and products from cannabis, natural or synthetic. The one exception is CBD. This is likely because while CBD has the potential to offer help to people, it does not, as discussed above, create a high. The WADA does warn, however, that some CBD products do have other cannabinoids in them. This means that athletes who use those kinds of CBD, may test positive for those banned cannabinoids.
